TERMS AND CONDITIONS FOR WEB HOSTING WEBSITE

These Terms and Conditions ("Agreement") govern the use of the web hosting services ("Services") provided by the web hosting company ("Provider") through its website ("Website"). By using the Services, you agree to be bound by this Agreement.

1. SERVICES
   1.1. rightVPS agrees to provide the Services to the Customer in accordance with the Service Level Agreement ("SLA") posted on the Website.
   1.2. rightVPS may modify the Services at any time, provided that any material changes will be communicated to the Customer in advance.

2. FEES AND PAYMENT
   2.1. The Customer agrees to pay the fees for the Services as set forth on the Website.
   2.2. The fees may be paid on a monthly, quarterly, or annual basis, as selected by the Customer.
   2.3. rightVPS reserves the right to suspend or terminate the Services if the Customer fails to pay the fees in a timely manner.

3. TERM AND TERMINATION 3.1. This Agreement shall remain in effect until terminated by either party. 3.2. The Customer may terminate this Agreement at any time by providing written notice to rightVPS. 3.3. rightVPS may terminate this Agreement immediately and without notice if the Customer breaches any term of this Agreement.

4. USE OF SERVICES
   4.1. The Customer agrees to use the Services only for lawful purposes and in accordance with applicable laws, rules and regulations.
   4.2. The Customer agrees not to use the Services for any illegal, fraudulent or harmful purpose, including but not limited to, the transmission of any material that is unlawful, defamatory, abusive, harassing, obscene, or that infringes any intellectual property rights.
   4.3. The Customer agrees not to use the Services to engage in any activity that violates the intellectual property rights of any third party, including but not limited to, copyright infringement, trademark infringement, or patent infringement.
   4.4. The Customer agrees not to use the Services to host any material that is illegal or offensive, including but not limited to, pornography, gambling, or hate speech.

5. CUSTOMER DATA
   5.1. rightVPS shall have no liability for any loss or corruption of Customer data hosted on rightVPS's servers.
   5.2. The Customer is responsible for maintaining backup copies of all Customer data.

6. SECURITY
   6.1. The Customer is responsible for maintaining the security of their account and ensuring that any passwords or login credentials are kept confidential and secure.
   6.2. The Customer agrees not to engage in any activity that compromises the security of the Services or other customers, including but not limited to, attempting to gain unauthorized access to any system, probing or scanning for vulnerabilities, or performing any other activity that could be used to breach security.

7. WARRANTY DISCLAIMER
   7.1. rightVPS makes no representations or warranties regarding the Services or the Website, and disclaims all warranties, express or implied, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
   7.2. rightVPS does not guarantee that the Services will be uninterrupted, error-free, or free from viruses or other harmful components.

8. LIMITATION OF LIABILITY
   8.1. rightVPS shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Services or this Agreement, even if rightVPS has been advised of the possibility of such damages.
   8.2. rightVPS liability under this Agreement shall be limited to the fees paid by the Customer for the Services during the preceding twelve (12) months.
